Online ordering terms and conditions

Last updated: 15 September 2026

These terms govern online food and drink orders for pickup at Chiringuito Ayo. Before paying, customers can review their order, total price, estimated pickup time and these terms.

1. Seller identification

  • Legal name: Chiringuito Ayo Nerja S.L.
  • Tax ID: B93290526
  • Trade name: Chiringuito Ayo
  • Address and pickup point: Paseo Antonio Mercero, s/n, Playa de Burriana, 29780 Nerja (Málaga)
  • Email: elchiringuitodeayo@gmail.com
  • Phone: +34 952 522 289

2. Pickup orders only

The website allows customers to order food and drink for in-person pickup at Chiringuito Ayo. We do not provide delivery. Orders are prepared for same-day pickup within the service hours and estimated time shown during checkout.

3. Products, prices and minimum order

Current product characteristics, formats, options, declared allergens and prices appear on each product page. Prices are in euros and include applicable taxes. Extras and supplements are shown separately before payment. There are no delivery charges. The current minimum order is shown in the basket.

4. Ordering process

  1. Select products, formats, options and quantities.
  2. Immediately before payment, review each item, its quantity and options, the total price and estimated pickup time.
  3. Provide a contact name and phone number and, if desired, a short general kitchen note naming the dish and requested change.
  4. Read and accept these terms.
  5. Select “Pay and place order” and complete payment through the virtual POS.

Adding items to the basket does not reserve them. The order is confirmed only after payment has been authorised and the website displays a confirmation code. The website then starts downloading the PDF receipt and keeps controls available to download or print it again. If the file cannot be generated or downloaded, the confirmation and order code will remain visible: customers may retry or request a copy atelchiringuitodeayo@gmail.com. The seller also archives the electronic order record. The contract may be completed in Spanish or English.

The note is printed on every order ticket generated for the order, so it does not replace product-specific options or add-ons.

5. Payment

Payment is made by bank card through the secure Redsys virtual POS. Full card details are entered in the payment provider's environment and are not stored by Chiringuito Ayo. If payment is rejected, cancelled or cannot be verified, the order is not confirmed and is not sent to the kitchen.

6. Pickup and availability

Pickup times are estimates based on current capacity. Customers must provide the order code when collecting. If an item becomes unavailable after payment, the restaurant will contact the customer. No substitution will be made without consent; if no alternative is accepted, the relevant amount or, where appropriate, the full order will be refunded.

7. Cancellations, withdrawal and refunds

These orders concern perishable food and drink and a catering service for a specific pickup date and time. Therefore, once an order is confirmed, the general fourteen-day withdrawal right does not apply under the statutory exceptions for goods liable to deteriorate or expire rapidly and for catering services supplied on a specific date or within a specific period (sections 103(d) and 103(l) of Spain's consolidated Consumer Protection Act).

The website does not offer automatic cancellation. Customers may call +34 952 522 289 or visit the restaurant as soon as possible to make a request. Chiringuito Ayo may voluntarily accept cancellation and a refund where preparation and operational circumstances allow, but this courtesy is not guaranteed and does not create a cancellation right. This does not limit statutory rights where an order is incorrect, defective, not as agreed, unavailable or the restaurant is otherwise in breach. Approved refunds are made to the original payment method.

8. Allergens

Each product page displays its declared allergens before purchase, and this information will also be available from staff at the restaurant during pickup. The kitchen handles a variety of ingredients and the accidental presence of traces cannot be completely excluded. Customers with a serious allergy must contact the restaurant before ordering and confirm it again with staff at pickup. The Notes field is only for preparation requests; it never replaces that direct confirmation and must not be used to communicate allergies.

9. Alcoholic drinks

Alcohol may only be purchased and collected by people aged 18 or over. Staff may request official ID at pickup and will not hand alcoholic drinks to a minor.

10. Customer service and complaints

Questions or complaints may be sent to elchiringuitodeayo@gmail.com, made by phone at +34 952 522 289, or submitted at the address above. Official complaint forms are available to consumers at the restaurant.

11. Personal data and applicable law

Data processing is explained in our privacy policy. These terms are governed by Spanish law and applicable consumer protection rules. Disputes will be submitted to the courts determined by mandatory consumer law.
